Resumen:  Antes de emprender el análisis lógico de las normas jurídicas constitucionales, o de las normas en general, es preciso intentar resolver una cuestión previa que afecta a la posibilidad de existencia de una lógica de las normas: el dilema de Jørgensen. Nuestra propuesta de solución de este dilema es la siguiente: las normas son expresiones performativas. Al mismo tiempo, las expresiones performativas son enunciados que tienen valor de verdad. Además, las normas jurídicas son enunciados del tipo “A dice p”, lo que explica que puedan existir normas verdaderas y, al mismo tiempo, contradictorias entre sí.

In 1492, a fatal robbery was committed in a small village in the Kingdom of Valencia. This article analyses the statements of the witnesses to a confession of this crime that were recorded in an Arabic document. The document provides evidence for the application of sharī'a law among Muslims in a territory that was no longer part of an Islamic state - in this case, the meting out of punishments for blood crimes. The survival of the document as part of the case file of the Christian court that adjudicated the case shows that the Valencian justice system considered valid documents produced by a Muslim judge, by a court clerk or by a notary. The controversy between Dworkin and legal positivism has lasted more than forty years. After Dworkin’s death, a reflection on this debate is needed. This paper faces some of the most important and popular arguments Dworkin advanced against legal positivism. More precisely, the article is divided in two main parts. The first is devoted to a critical presentation of three arguments developed by Dworkin in his early essays against Hart’s practice theory of norms. Using an extended version of the theory of planned behaviour to predict smoking cessation in two age groups

The aim of this study was twofold: (i) to test the utility of the theory of planned behaviour (TPB) in predicting intentions to quit smoking and subsequent behaviour in two age groups, and among women and men, and (ii) to examine whether descriptive norms, moral norms and past behaviour predict intentions and behaviour beyond the impact of the TPB components. Analyses were based on data from a prospective sample of 447 daily smokers (adolescents 16–19 years, n = 174, M = 17.5, adults 35–55 years, n  =  311, M  =  44 years). Paulson's Nomological Normativity

In some of his recent work Stanley Paulson puts forward a number of important and ambitious exegetical claims about Hans Kelsen’s Pure Theory of Law. Some of these claims are not novel in Paulson’s rich Kelsenian corpus. But, taken together, these claims now amount to the main outlines of a fully-fledged interpretation of the theoretical foundations of the Pure Theory of Law. It bottles up tragic contradictions, a feeling of insecurity, at times manifestations of despair and feverish activity. In the eyes of a considerable part of society man has lost his divine image, his place in the system of universal value. Consciousness of the loss of sense, the loss of absolute values forms a peculiar background for the cultural processes of the twentieth century. It is this loss of sense that may be the basis for its dualistic and even tragic vision of the world.

An extended version of the theory of planned behavour: Prediction of intentions to quit smoking using past behaviour as moderator

It was hypothesised that: (i) intentions to quit smoking were predictable from group identity, self-identity, moral norms and past quit attempts, beyond the components of the Theory of Planned Behaviour (TPB), and (ii) that past experiences with the behaviour (quit attempts) would increase the predictive utility of the extended TPB model on intentions. The data was collected among 357 daily smoking students (M = 24 years). The TPB components accounted for 12.3% of the variance in quitting intentions, while the extension variables added 16.5% to the explained variance in intentions beyond the impact of the TPB.
